Statement of Independence (as they relate to environmental authorizations and permit applications)
- The work quoted is provided independent of any outcome or decision being made as a result of
quoted work activities
- As independent consultants Londoloza cannot guarantee an outcome/ decision in favour of the
client/ proponent (EIA)
- As independent consultants Londoloza will function within the boundaries of its legislated mandate
as they relate to the NEMA (Act 107 of 1998) as well as the subsequent decisions
and regulations which results from such legislation.
Timelines and Service Delivery
- All applications for environmental authorisations will be submitted within two weeks from
completion of field work.
- All requests for information from stakeholders will be dealt with as soon as possible, but will have
a maximum turnaround time of one week.
- We will be acting in our capacity as technical business advisors and will be providing verbal and
written advice. The client is free to accept or ignore such advice.
- We will act in a professional and objective manner at all times.
- We cannot be responsible for any inaccuracies in the information provided by the client.
Payment
- An initial (retainer) deposit is required prior to the commencement of any work. This allows
Londoloza to provide the client with 60 days credit prior to suspension of work activities.
- Invoices will be immediately payable upon presentation, unless prior arrangements for alternative
payment options/ methods have been made.
- In the absence of arrangements being made, invoices paid later than 30 days will be levied with a
5% administrative fee for the first 30 days, thereafter a monthly interest charge of
5% will be levied to clients with interest being compounded daily.
- All payments are to be made via Electronic Funds Transfer (EFT)
- Disbursement costs are quoted as a fixed price and as such Londoloza carries the risk of
disbursements irrespective of real costs.
- Should the work be discontinued for whatever reason, the client will be liable to pay for the time
and disbursements incurred up to the time of the discontinuation of the assignment, at
the pre-agreed hourly rates.
Disputes and Conflict Resolution
- In the event of a dispute being declared by either Londoloza or the client it will be the
responsibility of either offending party to meet within a two working day period or the earliest
possible alternative time agreed between the two parties.
- Once an initial discussion has taken place, the offending party has 7 working days or the earliest
possible time agreed by both parties to implement corrective action.
- Should the dispute not be resolved mutually between Londoloza and the client the dispute will be
referred to an independent dispute resolution body for a final
resolution.
Confidentiality
- All information obtained during the course of consultation will be kept strictly confidential.
- This policy will/ can be wavered as and when need be for the purposes of public participation
processes or as contract and legal obligations may direct
